Terms and Conditions for Your Rental

 

You will receive detailed instructions about the arrival and the property by email.  Contact us if not received three days prior to arrival. 

 

House Rules for All Spaces

1. Smoking is NOT allowed inside the building. Smoking is allowed outside only. Please dispose of cigarette butts properly and be careful with the use of fire.

2. People other than those in the Guest party set forth above may not stay overnight in the property. Any other person in the property is the sole responsibility of guest.

3. All of the units are privately owned; the owners are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The Homeowners are not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise.

4. Keep the property and all furnishings in good order.  Only use appliances for their intended uses. 

5. Guest agrees that Internet access will not be used for illegal or illicit purposes and indemnifies Homeowner against criminal and civil prosecution for such conduct.

6. Pets are permitted only with prior approval, are generally limited to service animals, and the Pet Addendum must be used if a pet will stay at the unit. Note to those with allergies: cats reside in other areas of the building and dogs may have stayed in the unit in the past. Please keep in mind we thoroughly clean with HEPA type vacuums and all linens are laundered after every guest.

7. Parking: There is usually no limit to parking on the street near the building. NOTE that in winter, there are “Snow Emergencies” declared and your car must be off-street. NOTE that maintenance crews may prohibit parking, please look for signs. Consult with management regarding where to park at that time. Off street parking is generally limited to one vehicle(s), however two vehicles may be parked one behind the other in the reserved space. Vehicles are to be parked in designated parking areas only. Any illegally parked cars are subject to towing; applicable fines/towing fees are the sole responsibility of the vehicle owner.

8. Housekeeping: While linens and bath towels are included in the unit, daily maid service or laundry is not included in the rental rate. It is an option, however. Please ask about for cost. Please ask if you need beach towels. We do not permit standard bath towels or linens to be taken from the units.

9. Hot tub or jetted tub (if in this unit). No children are permitted to use any tub without constant adult supervision. When using the public beaches or tub, remember there is a certain health risk associated with all facilities. For instance diabetics should not use tubs for extended periods. The timer on the tub should be the maximum time of individual use. Use at your own risk. Our housekeepers sanitize tubs prior to your arrival. Be careful in using a jetted tub. There must be adequate water, but not too much water. Please do not overfill, there is no drain in the bath area.

10. Fire. Candle or other open flame use is not permitted inside the unit: Any outdoor firepit, gas barbecue or candles may be used with caution. Ask for assistance and instruction before using for the first time. Do not leave a fire unattended.  Ask for instruction if you have not used these items before, or if they are not identical to those you have used in the past.

11. Underage Drinking ./ Illegal Drugs: Guest(s) agree not to allow anyone under the age of 21 to consume alcoholic beverages on the premises. Resident(s) agree not to use nor permit the use of any non-prescription drugs on the premises.

12. Disrespectful Behavior: Guest(s) agree and understand that certain things won't be tolerated, including (without limitation) disrespect of property, property owners, neighbors, or company management. Guest(s) shall be respectful at all times. In the event of disrespectful behavior, guest(s) shall be liable for an additional $500 fee.

13. Holdover: Guest(s) agree and understand that they must vacate the premises upon expiration of the rental term date and time of day (11 AM unless prior agreement). In the event Resident(s) remain on the premises after the expiration of the rental term, Resident(s) shall be liable for standard rental rate plus $200/day additional fee until the guest(s) voluntarily leave or are evicted from the premises by the authorities.

Dear Guest(s):

 

Thank you for choosing us for your travel. We want to make your stay pleasant. Please let us know about any challenges or special needs.

 

We are not absentee owners. Think of us as the front desk of a hotel. But remember the front desk can be more than 30 minutes away!

 

This rental agreement is a lease to occupy the properties we represent, just as you would sign a lease for a property you live in on a long term basis. Your payment of a fee to rent this space is your agreement to the rental agreement / lease.

 

Your hosts are Scott Owens and Jenna Owens.

 

Our standard policies include:

 

   Booking is confirmed and this agreement is approved by guest when deposits are paid.

   If you have already paid your deposit by credit card over the phone or PayPal, you are confirmed.

   If you have already paid your deposit by credit card over the phone or PayPal, your have agreed to the terms of this booking confirmation and rental agreement.

   If you object to any part of the booking confirmation or rental agreement simply contact us by email and have us acknowledge within 24 hours of payment of deposit to cancel. You may also fax (US Only 877-679-6474) or mail (POBox 582299, Mpls., MN 55458). Again, if you have paid by credit card or PayPal, you have already agreed to these documents and do not need to separately sign and return. If you are accessing this document through our automated online booking system, you will be accepting through the website.

   If not paid at time of booking, your full rental fee must be paid 28 days before your arrival or your confirmation can be released. We will charge to your card on file, or you may call to make payment, or simply pay the full rental fee when you pay your deposit. If a confirmation is released for any reason prior to 28 days before arrival, your deposit and fees will be refunded.

   If paid in advance, we send back any security deposit within 28 days after the end of your stay. Security deposit by charge authorization will expire within a few days of your stay.

   Cancellations within one month (28 days): the deposit or rental fee is not refunded unless the property is re-rented.

   Cancellations after occupancy: Any refund is based on re-renting to other guests. If no refund is possible, a 100% credit for future stays is in effect for three years.

   Cancellations after occupancy: If there is a need or desire for cancellation because of any condition of the booked space, we must have the opportunity to propose a different space for you to occupy.

In general, email communication is preferred for non-urgent communication. (It can be received on multiple devices by multiple people.)

 

Voice mail is our second preference.

 

Text can also be used, especially the special texting instructions in each unit.

 

However in all cases, please make sure you get an acknowledgement. Electronic communications do not always go through!

 

NOTICE: Regarding parking be sure to obey all temporary or permanent signs on the property, or the public street. You should check where your car is parked at least every 24 hours for signs, etc. Snow Emergencies may require your car to be moved, parked on only one side of the street, or not parked overnight on the street. *** We cannot be responsible for tickets, towing or damage from parking at any location on or off the property. (No bailment is created for your vehicle or other property by this agreement.) ***

Cost for Guests above Regular maximum number of guests generally: $5 / person per night. Pet rent $25 / night, maximum $150 per pet per month.

 

Security / Key / Excess Cleaning or Damage Deposit or Fees. See Booking Confirmation.

 

Rental fees are:   Regular Daily/Nightly Rate for unit: See Booking Confirmation. Note Taxes and Departure Cleaning and Linen fees are in addition to rental rates.

 

Weekly Cleaning and Towel/Linen Laundry Fee may apply if noted in Booking Confirmation. See Booking Confirmation.

Normally we or our representative are present when you arrive.

 

Please give us notice on when you plan on arriving, and call us an hour before you will arrive.

SHORT TERM RENTAL AGREEMENT

This Short Term Rental Agreement (the “Agreement”) is made by and between __Scott Owens_ (“Homeowner”) and (“Guest”) See Booking Confirmation for dates of occupancy. Date of Agreement is first date of payment.

 

For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows:

 

   Property. See Booking Confirmation.Note that your reservation will be assigned to a particular property, however scheduling conflicts or maintenance issues mean that all reservations are "run of house", and can be satsified by other properties. Any change to a higher rate property will NOT require additional payment. Any change to a lower rate property will be accompanied by a refund or credit.

 

The property is furnished and includes standard furnishings, and/or See Booking Confirmation.

 

1. Rental Party: The rental party shall consist of Guest and the others that may be listed on booking confirmation. If pet is listed, Pet Addendum is incorporated by reference.

 

3. Maximum Occupancy: The maximum number of guests is limited to See Booking Confirmation. persons. An additional charge or $5 per person per night for guests in addition to maximum number of guests will apply.

 

4. Term of the Lease. Begins at 4:00 PM CT on Booking Confirmation “Check-in Date” and ends at 10:00 AM on the Booking Confirmation “Checkout Date”.

 

5. Minimum Stay: None. Cleaning charges apply to all lengths of stay. Maximum Stay, as specified on Booking Confirmation. Because of multiple reservations, stays can be extended only with prior approval. Or we may have nowhere to put the next guest!

 

6. Rental Rules: Guest agrees to abide by the Rental Rules listed here and in other documents and shall cause all members of the rental party and anyone else Guest permits on the property to abide by these rules.

 

7. Access: Guest shall allow Homeowner access to the property for purposes of repair and inspection, and also access to any utility room. Homeowner shall exercise this right of access in a reasonable manner. (We will always attempt to call or otherwise contact you before accessing the unit.)

 

8. Rental Deposit and Fees: Booking confirmation is incorporated by reference.

 

If the premises are unsatisfactory upon Check-in, Guest shall inform Host immediately. Host shall have the opportunity to correct any deficiency. Guest specifically agrees that accepting keys is acceptance of the condition of the property, which can include an agreement to correct any deficiency.

 

Guest agrees that amount of damages will include invoice amounts from third parties for repairs or replacements.

 

Security Deposit: A security deposit may be due at booking or any time during or after occupancy. If the deposit is for security, damage, lost keys, excess cleaning charges, etc.; and it will be refunded within approximately 28 days of the Checkout Date provided no deductions are made due to any unusual cost incurred by Homeowner due to Guest’s stay. Deposit may be credit card authorization, in which case it will expire if there is no damage, etc.

 

Rental fees. Payment in full of the rental fees shall be due at reservation or within 28 days of the Check-in Date:   See Booking Confirmation for details.

 

9. Cancellation Policy: If Guest wishes to cancel his/her reservation, the fees will be refunded as follows:

 

_100_% if cancelled more than_28_ days prior to the Check-in Date,

__0__% if cancelled _28_ days or less, unless re-rented.

__0__% if cancelled after occupancy. Three year credit on another stay available.

 

Any refund after occupancy and after hosts have the opportunity to correct any deficiency or propose alternate accommodations is subject to re-rating for actual occupied time.

 

10. Insurance: We encourage all renters to purchase traveler insurance. Below are some references you may contact to purchase such insurance:

You may be covered under your existing policies.

Arranging your stay through a website that offers policies.

You are NOT covered for losses under OUR policies.

 

11. Payment: Acceptable payment methods are credit card and PayPal in all instances.   Credit card, PayPal, electronic check, personal check may also be arranged.

 

If you wish to use a credit card, AND HAVE NOT ALREADY PROVIDED INFORMATION BY TELEPHONE or WEBSITE, please provide the following information or respond to online arrangements emailed to you.   You may send this form by fax or email (we recommend email only if you have scanned the image). If faxing, send to 877-679-6474. That number is an electronic mailbox and will deliver your fax to our email inbox. Because of the large amount of email we receive, please call 612-701-0900 to let us know when you fax or email any agreements. Thank you.

 

12. Liability: Liability under any circumstance, including overbooking, loss of personal property, injury while on property, etc. is limited to refund of the amount of charges under the agreement. Also, shipments before, during or after your stay should not be sent to any address without getting specific direct permission, and under no circumstances is there any liability for safe delivery on our part. We recommend that you arrange with a Mailboxes Etc. or other private post office type store to receive mail and packages.

 

Indemnification: Guest indemnifies Host for any liability, including attorneys' fees, that arise relating to reservation and occupancy.

 

Note that most of our properties were built before 1978, and therefore probably have lead paint in them. Of course the lead paint has long since been covered by other paint, but it may be a hazard if someone in your party wants to chew the woodwork! Consult with management regarding where to park at that time. Off street parking is generally limited to one vehicle(s). Vehicles are to be parked in designated parking areas only. Any illegally parked cars are subject to towing; applicable fines/towing fees and/or damage are the sole responsibility of the vehicle owner.

   Housekeeping: While linens and bath towels are included in the unit, daily or weekly housekeeping service is NOTE included in the regular rental rate. It is an option, however. Laundry facilities or facility access is provided in almost all units. We suggest you bring beach towels. Unless noted, we do not usually permit towels or linens to be taken from the units. We also do NOT permit your own bedding or mattresses to be brought into a unit, due to the high prevalence of pests in bedding in other localities. Pests can cost much more than your entire reservation payment to eliminate, and if you bring in bedding, we will charge for that treatment. If you need extra sleeping platforms for children and others, request in advance and they will be furnished at no charge.

   "Hot Tub" or "Jetted Tub": No children are permitted to use any hot tub or jetted tub without constant adult supervision. When using the public beaches or jetted tub, remember there is a certain health risk associated with all facilities. For instance diabetics should not use jetted tubs for extended periods. The timer on a jetted tub should be the maximum time of individual use. Use at your own risk. Our housekeepers sanitize tubs prior to your arrival. Be careful in using the jetted tub. There must be adequate water, but not too much water. Do not overfill, there is no drain in the bath area .

   Firepit or Barbecue: The outdoor firepit and/or charcoal or gas barbecue may be used with caution. Ask for assistance and instruction before using for the first time. Do not leave a fire unattended. Note that all fires are dangerous. Ask for instruction if you have not used these items before, or if they are not identical to those you have used in the past.

   Water and Sewer: The mineral content in the water in most cities is high because it is from a well, not a river. A water softener system may treat it. The sewer system is very effective; however, it will clog up if improper material is flushed. DO NOT FLUSH anything other than toilet paper. No feminine products should be flushed at anytime. If it is found that feminine products have been flushed and clog the sewer system, you could be charged damages of up to $259. If there is a slow drain, immediately inform management.

   Storms: No refunds will be given for storms. Minneapolis-St. Paul International Airport almost never closes. We highly recommend front wheel drive, four wheel drive and cautious driving in any case during the snow months. We do not refund due to weather or road conditions.

 

PET ADDENDUM -- Only applies if pets are acknowledged in reservation.

 

It is hereby agreed by and between (Homeowner) and (Guest) that homeowner will allow guest to have the following described pet and no others in the vacation home upon and subject to the terms and conditions of the rental agreement and this addendum.   The permission granted herein shall be limited to a certain pet as described below:

Guest hereby agrees to comply the following:

 

1. Guest to pay additional pet fee in the amount of $ 25 per pet, per day. Maximum $150 per pet, per month.

 

2. All pets must comply with the following specifications (documentation from an accredited veterinarian must be provided by Guest upon request):

 

           a. May not exceed 30-60 lbs.

           b. Must be at least 2 year(s) of age or older.

           c. Must be spayed or neutered.

           d. Must be up-to-date on rabies vaccinations and all other vaccinations.

           e. Heartworm preventive is highly recommended.

 

3. All pets must be leashed when there is a possibility they might run free inside or outside the unit.

4. Guest is responsible for cleaning up any/all pet refuse.

5. Pets are not allowed on furniture at any time. Any evidence of pets on furniture may incur extra cleaning fees.

6. All pets are to be treated with a topical flea and tick repellent three (3) days prior to arrival. Fleas and ticks are rampant in this area and can cause harmful/fatal illness to humans and pets.

7. Pet must not cause damage to premises or furnishings. If damages are caused, the cost of the damage may be deducted from security deposit and if it exceeds the deposit, you agree to be billed and pay the balance.

8. Guest should prevent pets from producing excessive noise at a level that disturbs neighbors.

9. Pet will not be left unattended for an undue length of time, either indoors or out. Pet will not be left unattended on patio, or in yard or on public property. The city requires pet leashing.

10. Homeowner assumes no responsibility for illness or injury that may occur to pets or humans while on the premises.

 

The Guest shall be solely responsible for the pet(s) while on the property.

 

Note that if you have given this information over the phone or inputted into website, you have indicated your approval of this agreement. You do NOT need to fill our credit card information or approve again.
